TERMS AND CONDITIONS OF SALE (TCS)
Please note that in the event of a dispute, only the French version of these Terms and Conditions of Sale shall prevail.
GENERAL TERMS
These Terms and Conditions govern the sale of products offered on the website www.JeSuisACroquer.ch.
Je suis à croquer Sàrl reserves the right to modify these Terms and Conditions at any time. The applicable conditions are those in force at the time of the order and available on the website.
By confirming the order, the customer fully accepts these Terms and Conditions.
The customer declares having the legal capacity to enter into a contract and certifies that the information provided during the order is accurate.
Je suis à croquer Sàrl reserves the right to refuse an order in case of suspected fraud, incorrect information, or insolvency.
PRODUCT AVAILABILITY
Products are offered while stocks last.
In case of unavailability after order confirmation, the customer will be informed as soon as possible and may choose between a refund or cancellation of the item concerned.
Je suis à croquer Sàrl does not guarantee restocking of all products.
Products are sold without any warranty other than those provided by applicable law.
Product images are non-contractual. Colour differences may occur between website visuals and actual products due to screens or image processing. No claims will be accepted on this basis.
Customers are advised to request additional photos or order samples to verify colour and quality. Samples are subject to a fee.
Customers are informed that fabrics may shrink after washing or soaking. Slight variations in length may also occur.
PRICES AND PAYMENT
Prices are shown in Swiss francs (CHF), VAT included unless otherwise stated.
Prices applicable are those displayed at the time of the order.
Je suis à croquer Sàrl reserves the right to cancel any order in case of payment issues.
Accepted payment methods:
- Bank transfer (prepayment): IBAN provided. Order number must be mentioned. Order processed upon receipt of payment. Orders unpaid after 7 working days are automatically cancelled.
- TWINT: secure payment via TWINT.
- PostFinance: secure payment via PostFinance Card or e-finance.
- Credit cards: Visa and MasterCard accepted. No banking data is stored.
Cheques are not accepted.
Orders are processed only after full payment has been received.
PROCESSING AND DELIVERY
Orders are generally processed within 1 to 5 working days.
Average delivery time is 3 to 7 working days within Switzerland (indicative).
Je suis à croquer Sàrl cannot be held responsible for delays caused by carriers or force majeure events.
Shipping costs depend on weight, volume, and destination.
Customs duties and taxes are the customer’s responsibility.
Risk transfers to the customer upon handover to the carrier, within the limits of applicable law.
Incorrect addresses provided by the customer may result in additional shipping fees.
RETURNS AND CLAIMS
Customers have 7 days after receipt to report a defective item.
Requests must be sent to info@jesuisacroquer.ch with photos and explanations.
After approval, a replacement or refund may be offered depending on availability.
Items must be unused, unwashed, undamaged, free of smoke odours, and in original condition.
Sale items, coupons, and custom products are non-returnable and non-exchangeable.
No returns are accepted for items previously ordered as samples.
In case of confirmed defects, return costs are covered by Je suis à croquer Sàrl.
ORDER CANCELLATION
Orders may be cancelled by the customer before preparation.
For credit card payments, cancellation fees of 3% of the total amount + CHF 3.– may apply.
ADDRESS ERRORS
If a parcel is returned due to an incorrect address, a CHF 11.– fee will be charged for reshipping.
The order will only be resent once payment is received.
LIABILITY
Je suis à croquer Sàrl is not responsible for typographical, photographic, or descriptive errors on the website.
The company is not liable for product unavailability, stock shortages, or force majeure events.
Force majeure includes natural disasters, strikes, transport or communication disruptions, or any event beyond the company’s control.
The customer is responsible for ensuring that purchased products comply with the laws of their country of delivery.
Customers confirm they are at least 18 years old or have legal guardian authorization.
Je suis à croquer Sàrl is not liable for allergic reactions related to fabrics.
DATA PROTECTION
Personal data is collected solely for order processing and commercial relations.
Data is treated confidentially and securely.
No personal data is shared with third parties without consent.
APPLICABLE LAW AND JURISDICTION
These Terms are governed by Swiss law.
Jurisdiction is located in Longirod (Switzerland), unless mandatory legal provisions state otherwise.
Parties agree to seek an amicable solution before any legal action.
FINAL PROVISIONS
The French version of these Terms and Conditions prevails in case of contradiction.
